Terms of Service

1. Scope of Services

Tapovan Heat Treaters provides commercial heat treatment services (including but not limited to normalizing, annealing, through hardening, tempering, stress relieving, and planned gas nitriding) and manufacturing sourcing solutions. All services are performed in accordance with written customer instructions, blueprints, and agreed-upon specifications.

2. Material Suitability & Documentation

Customers must supply accurate material certificates (detailing chemical composition and steel grade) and detailed drawings outlining target parameters (such as case depth, surface hardness range, and masking parameters). Tapovan is not responsible for processing failures, cracking, or dimensional variations resulting from:

• Hidden defects, micro-cracks, or internal gas porosity in castings, forgings, or bar stock supplied by the customer.
• Inaccurate, ambiguous, or incomplete chemical declarations.
• Prior cold-working, welding, or machining stresses that were not declared in writing.

3. Deliveries & Shipments

All materials must be delivered to our Shapar-Veraval plant with a clear delivery challan stating quantities, descriptions, and net weights. Tapovan does not assume transport risks or liability for transit damages, handling delays, or loading/unloading failures conducted by third-party freight carriers.

4. Quality Inspection & Acceptance

Processed materials must be inspected by the customer upon delivery. Any claims regarding discrepancies in hardness values, dimensional movements, or surface scale must be submitted to Tapovan in writing within seven working days of material receipt. In the event of established processing errors, Tapovan's liability is strictly limited to re-treating the affected parts without charge or refunding the treatment fee.

5. Limitation of Liability

Under no circumstances shall Tapovan Heat Treaters be liable for any indirect, incidental, special, or consequential damages. This includes, without limitation, loss of business profits, assembly line downtime, structural failures in service, or transport claims. Our maximum liability per batch shall not exceed the service charge invoiced for that specific batch.

6. Payment Terms

Invoices are generated upon completion of the heat treatment cycles and are payable according to individual credit terms established in writing. Late payments are subject to interest charges. Tapovan retains a lien over all customer materials currently in our possession until outstanding service balances are paid in full.

7. Jurisdiction

These terms of service shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Rajkot, Gujarat.
